New IBBI regulations bring project-wise reviews, clearer possession procedures and stronger homebuyer participation when real estate developers face insolvency.

India’s real estate buyers may get stronger protection when a developer faces financial failure. The Insolvency and Bankruptcy Board of India (IBBI) notified its Fifth Amendment Regulations, 2026, on October 30, introducing changes to the insolvency resolution process for companies with real estate projects.

The amendment provides for project-wise construction and cost assessments, clearer possession and registration procedures for eligible buyers, and greater homebuyer representation in monitoring committees. Creditors holding at least 66% voting share can recommend excluding an individual project from insolvency proceedings, subject to approval by the adjudicating authority.

For buyers, the development makes it important to check more than a builder’s RERA registration. Before booking, verify approvals, title documents, project status, payment records and possession commitments. If a developer enters insolvency, buyers should track official notices, submit claims correctly and seek professional legal advice. The new rules improve the resolution framework; they do not guarantee immediate possession or a refund in every case.
